LAKEPORT— A Clearlake man who led Lakeport Police on a high-speed chase in a stolen vehicle was in custody, recently appearing at the Lake County Superior Court in Lakeport.
The Court read and considered the Report and Recommendation of the Probation Officer for the defendant, Samuel William Rhea, 49.
Probation was denied for the defendant and the Court made the finding that the defendant has a demonstrated history of substance abuse.
It is the judgment of the Court that the defendant is guilty of a felony violation of vehicle theft, VC10851(a), and that as punishment he be imprisoned in state prison for 16 months.
The Court also placed further judgement that the defendant is guilty of a felony violation of evading a peace officer, VC2800.2(a), and that as punishment he be imprisoned in state prison for 16 months. This term is to be served concurrent to the VC10851(a) term imposed, making a total term of 1 years, 4 months.
The defendant was awarded 58 days of credit for time served and 58 days of conduct credits for a total of 116 days credit.
There were orders to pay restitution fines totaling $600 with a court operation assessment fee of $80 and a criminal conviction assessment fee of $60. Restitution is reserved for the victim.
The defendant has been remanded to the custody of the Lake County Sheriff and delivered to the California Department of Corrections and Rehabilitation.
In July the defendant entered a nolo plea for both of his charges.
Nolo means No Contest – this plea means the defendant is not pleading guilty or not guilty, but simply accepting the charges and agreeing to the fine and sentence.
The charges stem from an incident in July when the Lake County Sheriff's Office was dispatched to the Power Market in Lakeport regarding the theft of a vehicle.
The victim told police she had picked up an adult white male who was walking alongside Highway 29 and provided him a ride to the Power Market.
The victim and another party in the vehicle entered the market and upon return to the vehicle, it was gone. Further investigation of the market's surveillance camera revealed the man taking the victim's vehicle.
Later that evening a Lake County Sheriff Deputy spotted the stolen vehicle southbound on Highway 29 traveling over the speed limit.
When the deputy attempted to stop the vehicle, the driver refused and a high speed vehicle pursuit ensued, which later became a foot pursuit.
The Lake County Sheriff's Deputy identified the suspect and later booked the defendant into the Lake County Jail.
